1. Acceptance of Terms

By accessing and using StayingIn LJ ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Nature of Items - Vintage and Used Goods

Important Notice: All items sold through StayingIn LJ are vintage, antique, or previously owned goods. By purchasing any item, you acknowledge and agree that:

• Items are NOT new: All pieces are pre-owned, vintage, or antique items with a history of use
• Expected wear and character: Items may show signs of age, wear, patina, scratches, dents, fading, or other characteristics consistent with their vintage nature
• Condition descriptions: We provide honest descriptions and photographs, but minor imperfections may not be visible or mentioned
• Sold as-is, without warranty: Items are sold in their current condition and may have manufacturing flaws, repairs, or modifications from their original state
• Character features: Wear, patina, and aging are considered desirable characteristics that add to the vintage appeal and are not defects

3. Item Descriptions and Photography

We strive to provide accurate descriptions and photographs of all items. However:

• Colors may vary slightly due to photography lighting and monitor settings
• Dimensions are approximate and may vary slightly
• Minor imperfections consistent with vintage items may not be individually documented
• All sales are final based on the description and photographs provided

4. Sales and Returns

All sales are final. Due to the unique nature of vintage items, we do not accept returns, exchanges, or provide refunds except in cases of:

• Significant damage during shipping that was not disclosed
• Item received differs substantially from the description provided
• Our error in shipping (wrong item sent)

Claims must be made within 48 hours of delivery with photographic evidence.

5. Payment and Pricing

• All prices are in USD and include applicable taxes
• Payment is processed securely through Stripe
• A $5 processing fee is added to shipped orders over $30 (shown at checkout)
• Prices are subject to change without notice

6. Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute through your bank or credit card company:

• We will contest all unwarranted chargebacks with evidence of proper fulfillment
• You must provide documented proof of any claim (photos, shipping damage, etc.)
• Frivolous disputes may result in account suspension and collection efforts

7. Shipping and Local Pickup

Shipping:

• Items are carefully packaged but vintage items may be fragile
• Shipping costs are calculated based on size, weight, and destination
• We are not responsible for damage during shipping unless inadequately packaged
• Delivery times are estimates and not guaranteed

Local Pickup:

• Available in San Diego area by appointment
• Items must be picked up within 14 days of purchase
• Buyer is responsible for safe transport after pickup

8. Limitation of Liability

You expressly understand and agree that StayingIn LJ shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

• The use or inability to use our service
• The condition, quality, or performance of vintage items purchased
• Normal wear and tear characteristics of vintage items
• Any interactions with other users

9. User Conduct

Users agree not to:

• Use the service for any unlawful purpose
• Harass, abuse, or harm other users
• Post inappropriate or offensive content
• Attempt to manipulate pricing or availability
• Reverse engineer or attempt to access restricted areas

10. Intellectual Property

The service and its original content, features, and functionality are owned by StayingIn LJ and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11. Privacy Policy

Your privacy is important to us. We collect and use information in accordance with our Privacy Policy, which is incorporated into these terms by reference.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the service constitutes acceptance of any changes.

13. Governing Law

These terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the courts of San Diego County, California.

14. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
